(1) The appellant, Chih I. Woo, was convicted after a Bench trial in the Superior Court of possession of cocaine in violation of 16 Del.C. § 4753. Woo unsuccessfully moved to suppress the evidence seized from his person following his arrest along with three other individuals in a parking lot in Newark. The trial Judge ruled that suspicious circumstances then present provided the arresting officers with the basis to form a reasonable albeit mistaken belief that Woo was in possession of marijuana.
